SENATOR ORRIN HATCH INTRODUCES LEGISLATION ENABLING MILITARY RETIREES TO APPLY FOR FEDERAL LAW ENFORCEMENT POSITIONS UP TO AGE 47

U.S. Senator Orrin Hatch of Utah has introduced legislation as part of the Defense Authorization Act that would raise the entry age from 37 to 47 for military personnel seeking employment in special federal careers such as law enforcement and firefighting.  The age limit for civilians will remain at 37.  This significant benefit for military personnel is long overdue and the AFSAA salutes Senator Hatch for championing this important change.  In remarks regarding his proposal, Senator hatch said, "By increasing the maximum age for these vitally important positions, we are giving military retireees who served honorably for 20 years or more the opportunity to apply.  Providing them with the opportunity to put their impressive expertise and skills to work for the federal government is not only the right thing to do, but also will enhance public safety and national security."

AFSAA strongly endorses the Hatch proposal and will be tracking House action in the months to come.

UPDATE ON MSPB Decision of Note:

On August 26, 2009, OPM Director John Berry issued a memorandum to all heads of Executive Branch agencies announcing a government-wide policy that arose out of a July MSPB decision involving a veteran-preference eligible applicant for a Diplomatic Security Service law enforcement position.  As we reported last year, the MSPB ordered the State Department to waive the maximum age entry level requirement (37) for the applicant, Robert P. Isabella, because they had not shown that the age requirement was essential to the position.  Berry cautioned federal agencies that they must waive the age requirement absent such a showing for applicants under the Veteran Employment Opportunities Act of 1988.
